The Online Gallery area on Kunstplaza is intended to create a platform and marketplace for creative people to offer and promote their works. There are people here who have a great passion for handmade and unique works and who create them with a lot of creative energy, perseverance and dedication.
We would like to take the needs and expectations of these people very seriously and, with you as a member or visitor, create and promote a lively, colorful and thriving market.
In order to make this possible and ensure it in the long term, everyone involved must adhere to a number of important guidelines and principles. We ask you to read these principles carefully and adhere to them. In addition to our General Terms and Conditions, they will give you an overview of what is permitted and what is prohibited in the Kunstplaza online gallery area.
We would like to point out that as a provider of works of art, you are responsible for ensuring that your actions comply with legal regulations and our conditions.
Please note:
If there are concrete indications or indications of violations of our principles, we reserve the right to delete your ad(s) in whole or in part without prior notice. In addition, we may impose and implement further sanctions, such as restricting certain functions or blocking your user account. Repeated or serious violations may lead to exclusion from the platform (termination by Kunstplaza).
1) We are happy about the following things at Kunstplaza:
Uniques and originals
The Kunstplaza online gallery is a marketplace for unique art objects and handmade pieces. Of course, you can place any items with us that have been created by hand and individually. We are particularly happy about creative works that stand out, for example due to the material used, the method of production or the intended use.
Using the categories provided in the online gallery, you can get an overview of what type of works you can post. However, this list is not intended to be final. If you have something in mind that cannot be classified into any of the existing categories, then just let us know. We would be happy to create another category for you.
A real signature and/or a certificate of authenticity is always particularly appreciated.
Strictly limited reproductions
Limited reproductions (e.g. art prints, urban art, photographs, etc.) are also suitable for advertising in our online gallery. However, these should be expressly limited, with an indication of the edition or the limited number of pieces as well as a signature or a certificate. No off-the-shelf or mass-produced products may be listed.
Homemade products
Only handmade, individualized, refurbished, restored, refined or made-to-measure products may be offered on Kunstplaza.
Trading as a reseller
As a provider of works and articles, you do not necessarily have to be the author or manufacturer of the product yourself. As a dealer, designer, collector, gallery owner or reseller, you can also publish advertisements and post works in the online gallery.
In this case, however, we ask you to note the following points:
- The author of the work must be named in the advertisement description with his first and last name. It must be clear that you are merely the dealer, acting as a representative of the author, or merely distributing.
- You must have written permission from the author allowing you to resell the work or a document confirming your ownership rights to the work (e.g. purchase agreement, etc.). You must be able to provide us with this proof upon request.
- Handmade items and works from third world and emerging countries may not be offered if they do not come from fair trade. You must be able to provide us with this proof in the form of a certificate upon request.
2) We don’t want to see the following things on Kunstplaza:
Of course, everything that cannot be offered, sold or published for legal reasons is prohibited on Kunstplaza. In addition, we establish our own principles and determine which items may not be offered by us beyond the legal regulations.
Please note that the list of items that are prohibited for legal reasons given here is not exhaustive and you are obliged to additionally inform yourself sufficiently whether you are allowed to trade or offer an item or service.
a) Legal prohibitions:
Stolen goods/stolen goods
Objects that were obtained unlawfully or illegally may not be offered. For example, if an item comes from a break-in, you may not offer it. This applies even if you had nothing to do with the break-in.
Counterfeits, plagiarism, imitated brand products, use of brand names and protected logos and motifs
It is prohibited by law to offer works that bear a logo or brand name of a company even though they do not originate from that company.
At the same time, it is forbidden on Kunstplaza to advertise that a work is similar to a product from a brand company. In addition, it is prohibited to post and offer works for the production of which a specific design was illegally copied.
Images, photos, pieces of text and other files that are protected by copyright if the user has not acquired a right of use
Copyright applies. Please inform yourself sufficiently about this. When posting works on Kunstplaza, you must ensure that you have the right to use a photo, image, piece of text, file or other content for publication. If you have any doubts, you should consult a lawyer.
Films, music and photos as copies
Offering and selling copies of films, music and photos, etc. are not permitted. on writable data carriers. We would like to point out that copyright applies and that you must inform yourself about its scope. This excludes authorized copies and reproductions of photographs; In this case, it must be stated in the offer that a corresponding permit is available and proof of this must be provided upon request.
Media/items harmful to minors
In principle, only people who are of legal age are allowed to become members of Kunstplaza. However, it should be noted that we will not always be able to prevent users who are not yet 18 years old from registering or otherwise gaining access to the member area.
As a provider of an item that may only be purchased by adults, you must therefore ensure that only an adult receives this item (e.g. in the form of a personal delivery or by PostIdent). Furthermore, for reasons of protecting minors, you are not permitted to publish images or descriptions of an item or service on Kunstplaza that may already be harmful to minors. So please avoid texts or images that may not be suitable for minors.
Content that violates common decency
The concept of good manners is difficult to define in a generally binding manner. We attach great importance to the fact that the Kunstplaza online gallery only offers individually and handcrafted works and items and that our users act seriously and appropriately.
If an advertisement, a work, an offer, a service or the behavior of a member does not suit us and our guidelines, we reserve the right to delete the corresponding offer and/or to warn, block or even terminate the member and remove his or her account.
Please always note that people from different cultures and/or with different religious backgrounds are registered and active with us. Please take this into consideration!
Propaganda articles from banned parties, associations and groups/articles from anti-constitutional organizations/calls to commit crimes
The law applies, according to which the distribution of propaganda materials of unconstitutional organizations is prohibited, as is the use of symbols of unconstitutional organizations, sedition and denigration of the memory of the deceased. We also exclude documents of the type mentioned that are intended to be traded for collector purposes. Militaria also have no place on Kunstplaza.
Items, clothes, ID cards or other items from security-relevant areas such as uniforms/licenses and identification documents from authorities
It is prohibited to offer works and articles on Kunstplaza that pose a high risk of misuse. This includes, among other things, all real or real-looking uniforms and parts of uniforms, name tags, as well as ID cards of the police, army, secret services, fire brigade, security personnel and airport staff worldwide. Excluded from this ban are antique uniforms and ID cards that are no longer valid.
Hazardous chemicals/banned electronic devices
Offering and trading toxic substances and dangerous chemicals is prohibited on Kunstplaza. Please inform yourself carefully about the legal situation if you use certain ingredients that are questionable in the production of your works.
Before offering electronic devices or works with corresponding electronic components, you must also find out exactly whether trading is permissible. All devices must have a CE marking. An exception is possible for antique devices that are no longer usable.

Illegal drugs
The Narcotics Act and criminal law apply. Please note that trading in goods or objects used for drug use is also prohibited on Kunstplaza. Exceptions only exist if it is not expressly prohibited by law in the relevant case and no request or instructions for drug use are included in the item description.
b) Additional prohibitions:
In addition to the legal prohibitions already listed, we have a few more things that we do not allow on Kunstplaza:
- Offering weapons and ammunition of any kind is prohibited
- We prohibit the offering of live animals and things made with parts and/or products from protected animals and plants. The species protection regulations of the Washington Convention on Endangered Species, the resulting EU Regulation No. 338/97 and the Federal Nature Conservation Act apply.
- The offering of food or items intended for consumption is currently not permitted. A large number of regulations apply to the trade in food in Germany and the risk is difficult to estimate.
- The offering of textiles that are primarily intended to be worn is also currently not permitted. When trading textiles, various laws must be observed in Germany (e.g. the Textile Labeling Act) and the risk cannot be estimated for us at the moment.
- The offering of children’s toys or items made for children’s use is also not permitted on Kunstplaza. Due to various legal requirements and statutory security requirements, the risk for those involved is currently not borne by us.
3) Guidelines and principles for smooth operations in the online gallery
a) Be fair to other members and to Kunstplaza
We clearly see ourselves as a community and we all benefit from constructive cooperation. Please always treat other Kunstplaza members in a friendly, fair and respectful manner.
Misunderstandings sometimes arise between people and not everything always goes as planned. However, solutions and mutually acceptable paths can often be found if we remain friendly, communicate openly and authoritatively, and strive to find a common consensus. In the vast majority of cases, amicable agreements can be reached for all parties involved.
Please avoid insults, slander and inappropriate language on Kunstplaza. In this context, please also note that such behavior can even be prosecuted under criminal and civil law.
We strive to ensure that you are satisfied as a member of our online platform and achieve good results. Therefore, a number of rules must be followed to ensure everything runs smoothly.
The following behavior is prohibited:
- Addressing other Kunstplaza members via comments, profile or ad pages or via the message function, with the sole intention of drawing their attention to external offers (e.g. online shops, etc.).
- The mention of external offers and the placement of links to them in the online gallery advertisements, in comments or other contributions on Kunstplaza, provided that these do not directly refer to the user’s works or their homepage. The promotion of other websites of a brand, company or social network sites is only permitted if they are directly related to the ad or post.
- Placing links in posts on Kunstplaza with the sole intention of using them for search engine optimization purposes.
- The use of contact details obtained via the Kunstplaza platform for purposes other than direct communication and processing of transactions initiated via Kunstplaza.
- Deliberately publishing false information of any kind.
If there are concrete indications of violations of this fairness requirement and the rules listed, we reserve the right to delete or block your offers and advertisements in whole or in part without prior notice.
Repeated or serious violations may lead to exclusion from the Kunstplaza platform (termination).
b) Select the appropriate category for your ad
The world of art is extremely comprehensive and can hardly be contained within limits. Furthermore, as an organic being, it is subject to constant change. That’s why we’re constantly expanding our categories and we strive to offer the right category for almost every work.
If works are classified in the wrong or inappropriate category, this confuses interested parties and potential buyers. They, as well as other artists offering, may react angrily. This may be especially true if there is obviously a suitable category in the Kunstplaza online gallery. You would certainly be frustrated if you didn’t find the works you expected in a category of your choice.
Therefore, take some time to explore the categories of the online gallery and select the one that suits you best. Sometimes it may be that more than one category applies to your specific work. In such a case, please choose one of these categories.
If there is no suitable category, you are welcome to simply send us a short message with the name of the desired category. We will then be happy to create this for you.
c) Describe your works/articles in detail
Works and items made individually, with love and by hand certainly deserve to be presented lovingly and in detail. The quality of your images also plays a central role in putting them in the right light. Therefore, please take some time to design the description and produce or select the image material.
Please note that these texts and images must not violate applicable law, copyright and especially trademark law. Describe your items carefully and at the same time pay attention to the legal requirements that your description may have to meet. Avoid advertising with someone else’s name or brand (unless you have sufficient rights to do so), as this is anti-competitive and also dangerous as you violate trademark and/or licensing rights and therefore risk being warned.
d) Make use of additional information
Depending on the category you choose for your work, you may have a number of additional options to provide additional information about your item. Make use of this as it increases the likelihood of being found by interested parties. At the same time, you give them further important details about your item.
In the description, also use relevant terms and keywords that you would like to use to be found using the search function or, in some cases, directly via Google. Using the right keywords makes it easier for potential buyers to find your item or work.
The terms you choose must of course have a meaningful connection to your article. If this connection does not exist, there is a violation of our principles. After all, with such behavior you are misleading users on Kunstplaza.
If there are concrete indications of violations of these guidelines, we reserve the right to delete or block your ad(s) in whole or in part without prior notice.
Repeated or serious violations can lead to exclusion from participation in the Kunstplaza online gallery.
e) Place links carefully and carefully
Links that direct members and visitors to the platform to external, commercial websites are prohibited on Kunstplaza.
If you run your own website, keep a blog or want to link your fan or company page on a social network (e.g. Facebook, Pinterest or Twitter), you can do this in the description of your ad in the appropriate place (see provided field), on your profile or in the community groups.
You are also welcome to link to information that provides more detailed information about components of your advertisements, works or offers
However, when setting links, always remember that you are responsible for checking whether the linked pages comply with applicable law.
f) Be discreet
We all want to protect our data and privacy. Therefore, do not publish any personal information that you do not want or are not allowed to disclose to third parties. In this context, please note the setting options in your user account and the corresponding information.
Do not publish messages, emails, contact details or other information of a private nature that you have received from other members.
