Therefore, it is primarily frequented by people who have a great passion for handcrafted and unique pieces, creating them with considerable creative energy, perseverance, and dedication.
We want to take the needs and expectations of these people very seriously and create and promote a vibrant, colorful and thriving market with you as a member or visitor.
To make this possible and ensure its long-term sustainability, all parties involved must adhere to a number of important guidelines and principles. We ask you to read and comply with these principles carefully. In addition to our General Terms and Conditions is permitted and prohibited within the Kunstplaza
We would like to point out that as a provider of artworks, you are responsible for ensuring that your actions comply with legal regulations and our terms and conditions.
Please note:
If there is concrete evidence or indication of violations of our principles, we reserve the right to delete your advertisement(s) in whole or in part without prior notice. Furthermore, we may impose and implement further sanctions, such as restricting certain functions or blocking your user account. Repeated or serious violations may lead to exclusion from the platform (termination by Kunstplaza ).
1) We are pleased about the following things on Kunstplaza :
Unique and original pieces
The Kunstplaza online gallery is a marketplace for unique art objects and handcrafted pieces. Of course, you can list any items with us that are handmade and individually created. However, we are particularly interested in creative works that stand out, for example, due to the material used, the method of production, or their intended use.
The predefined categories in the online gallery will give you an overview of the types of artwork you can upload. However, this list is not exhaustive. If you have something in mind that doesn't fit into any of the existing categories, please let us know. We'd be happy to create a new category for you.
A genuine signature and/or a certificate of authenticity is always particularly appreciated.
Strictly limited reproductions
Limited edition reproductions (e.g., art prints, urban art, photographs, etc.) are also suitable for submission to our online gallery. These must be explicitly limited, with a statement of the edition size or limited number of copies, as well as a signature or certificate. Off-the-shelf products or mass-produced items are not permitted.
Handmade products
Only handmade, individualized, refurbished, restored, refined or custom-made products may be offered on Kunstplaza .
Trading as a reseller
As a provider of artworks and articles, you do not necessarily have to be the author or manufacturer of the product yourself. You can also publish advertisements and list works in the online gallery as a dealer, designer, collector, gallery owner, or reseller.
In this case, however, we ask you to observe the following points:
- The advertisement description must include the full name of the author of the work. It must be clear that you are merely the seller, acting as the author's representative, or only handling distribution.
- You must have written permission from the copyright holder authorizing you to resell the work, or a document confirming your ownership rights to the work (e.g., a purchase agreement, etc.). You must be able to provide this proof upon request.
- Handmade items and products from developing countries and emerging economies may not be offered for sale unless they are Fair Trade certified. You must be able to provide us with proof of this in the form of a certificate upon request.
2) The following things are things we do not want to see on Kunstplaza :
Naturally, anything that cannot be offered, sold, or published for legal reasons is prohibited on Kunstplaza . Furthermore, we establish our own guidelines and specify which items, beyond those required by law, may not be offered on our platform.
Please note that the list of items prohibited by law is not exhaustive and you are required to additionally inform yourself whether you are allowed to trade in or offer a particular item or service.
a) Legal prohibitions:
Stolen goods/fenced goods
Items obtained unlawfully or illegally may not be offered for sale. For example, if an item was stolen during a burglary, you may not offer it for sale. This applies even if you had nothing to do with the burglary.
Counterfeits, plagiarized goods, imitation branded products, use of brand names and protected logos and designs
It is against the law to offer works that bear a company's logo or brand name if they are not from that company.
Similarly, it is forbidden on Kunstplaza to advertise a work as being similar to a brand's product. Furthermore, it is prohibited to upload and offer works for which a specific design was unlawfully copied.
Images, photos, text pieces and other files that are protected by copyright, if the user has not acquired a right of use
Copyright law applies. Please inform yourself sufficiently about it. When uploading works to Kunstplaza , you must ensure that you have the right to use the photograph, image, text, file, or other content for publication. If in doubt, you should consult a lawyer.
Movies, music and photos as copies
Offering and selling copies of films, music, photos, etc., on recordable media is prohibited. Please note that copyright law applies and that you are responsible for informing yourself about its scope. Authorized copies and reproductions of photographs are exempt from this restriction; in this case, the offer must state that the necessary permission has been granted and must be provided upon request.
Media/objects harmful to minors
Generally, only people of legal age are allowed to become members of Kunstplaza . However, it should be noted that we will not always be able to prevent users under 18 from registering or otherwise gaining access to the members' area.
As a seller of an item that may only be purchased by adults, you must ensure that only an adult receives this item (e.g., through personal delivery or PostIdent verification). Furthermore, for reasons of youth protection, you are not permitted to publish images or descriptions of an item or service on Kunstplaza that could potentially be harmful to minors. Therefore, please refrain from posting any text or images that might be unsuitable for minors.
Content that violates public decency
The concept of good morals is difficult to define universally. We place great importance on the fact that only individually and handcrafted works and items are offered in the Kunstplaza online gallery, and that our users act in a reputable and appropriate manner.
Should an advertisement, work, offer, service or the behavior of a member not be in line with us and our guidelines, we reserve the right to delete the offer in question and/or warn, suspend or even terminate the member and remove their account.
Please always bear in mind that people from different cultural backgrounds and/or with different religious beliefs are registered and active with us. Please be considerate of this!
Propaganda articles from banned parties, associations and groups / Articles from anti-constitutional organizations / Incitement to criminal acts
The law prohibits the dissemination of propaganda materials from unconstitutional organizations, as well as the use of symbols of unconstitutional organizations, incitement to hatred, and defamation of the memory of the deceased. We also exclude documents of the aforementioned type intended for collectors' purposes. Military memorabilia is also prohibited on Kunstplaza .
Items, clothing, identification documents or other items from security-relevant areas such as uniforms/licenses and identification papers from authorities
It is prohibited to offer works and items on Kunstplaza that pose a high risk of misuse. This includes, among other things, all genuine or authentic-looking uniforms and parts of uniforms, name tags, as well as identification documents of the police, army, intelligence services, fire department, security personnel, and airport staff worldwide. Antique uniforms and identification documents that are no longer valid are exempt from this prohibition.
Hazardous chemicals/prohibited electronic devices
Offering and trading in toxic substances and hazardous chemicals is prohibited on Kunstplaza . Please inform yourself thoroughly about the legal situation if you use questionable ingredients in the creation of your artwork.
Before offering electronic devices or works containing electronic components for sale, you must thoroughly research the legality of trading them. All devices must bear a CE marking. An exception is possible for non-functional, antique devices.
Illegal drugs
Narcotics laws and criminal law apply. Please note that trading in goods or items intended for drug use is also prohibited on Kunstplaza . Exceptions exist only if it is explicitly permitted by law in the specific case and the item description does not contain any incitement or instructions for drug use.
b) Additional prohibitions:
In addition to the legal prohibitions already listed, there are a few more things that we do not allow on Kunstplaza :
- Offering weapons and ammunition of any kind is prohibited
- We prohibit the offering of live animals as well as items made with parts and/or products from protected animals and plants. The species protection regulations of the Washington Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), the resulting EU Regulation No. 338/97, and the German Federal Nature Conservation Act apply.
- Offering food or items intended for consumption is currently prohibited. The trade in food products is subject to numerous regulations in Germany, and the risk is difficult to assess.
- Offering textiles primarily intended for wear is also currently prohibited. Various laws apply to the trade in textiles in Germany (e.g., the Textile Labeling Act), and we are currently unable to assess the risk.
- Offering children's toys or items manufactured for children's use is also not permitted on Kunstplaza . Due to various legal regulations and statutory safety requirements, we cannot currently bear the risk to those involved.
3) Guidelines and principles for a smooth operation in the online gallery
a) Be fair to other members and to Kunstplaza
We clearly see ourselves as a community and all benefit from constructive cooperation. Therefore, please always treat other Kunstplaza members in a friendly, fair, and respectful manner.
Misunderstandings sometimes arise between people, and things don't always go as planned. However, solutions and mutually acceptable paths can often be found if everyone remains friendly, communicates openly and respectfully, and strives to reach a common consensus. In the vast majority of cases, amicable agreements can be reached for all parties involved.
Please refrain from insults, defamation, and inappropriate language on Kunstplaza . Please also note that such behavior may be subject to criminal and civil prosecution.
We strive to ensure your satisfaction and success as a member of our online platform. Therefore, a number of rules must be observed to guarantee a smooth process.
The following behavior is prohibited:
- Contacting other Kunstplaza members via comments, profile or ad pages or via the messaging function, with the sole intention of drawing their attention to external offers (e.g. online shops, etc.).
- Mentioning external offers and placing links to them in advertisements on the online gallery, in comments, or other posts on Kunstplaza is prohibited, unless these links directly refer to the user's own works or their website. Promoting other websites of a brand, company, or social media pages is only permitted if they are directly related to the advertisement or post.
- Placing links in posts on Kunstplaza with the sole intention of using them for search engine optimization purposes.
- The use of contact details obtained via the Kunstplaza platform for purposes other than direct communication and processing of business transactions initiated via Kunstplaza .
- The deliberate publication of false information of any kind.
If there is concrete evidence of violations of this fairness principle and the listed rules, we reserve the right to delete or block your offers and advertisements in whole or in part without prior notice.
Repeated or serious violations may lead to exclusion from the Kunstplaza platform (termination).
b) Choose the appropriate category for your ad
The world of art is extremely vast and almost impossible to define. Furthermore, as an organic entity, it is subject to constant change. Therefore, we are continuously expanding our categories and strive to offer a suitable category for almost every work of art.
If artworks are placed in the wrong or an unsuitable category, it confuses interested parties and potential buyers. These individuals, as well as other artists offering their work, may react with frustration. This is especially true if there is clearly a suitable category in the Kunstplaza online gallery. Surely you, too, would be frustrated if you couldn't find the artwork you were expecting in your chosen category.
Therefore, please take some time to familiarize yourself with the categories in the online gallery and select the one that best suits your needs. Sometimes, more than one category may be relevant to your specific work. In such a case, please choose one of these categories.
If no suitable category exists, please feel free to send us a short message with the name of the desired category. We will then gladly create it for you.
c) Describe your works/articles in detail
Individually crafted works and items made with love and care certainly deserve to be presented with attention and detail. The quality of your images also plays a crucial role in showcasing them in the best possible light. Therefore, please take some time to craft the description and create or select the images.
Please note that these texts and images must not violate applicable law, copyright law, and especially trademark law. Describe your items conscientiously and adhere to any legal requirements your description may need to meet. Avoid advertising with other people's names or trademarks (unless you have sufficient rights to do so), as this is anti-competitive and also dangerous, since you infringe trademark and/or licensing rights and risk receiving a cease-and-desist letter.
d) Make use of additional information
Depending on the category you choose for your work, you may have several additional options to provide further information about your item. Make use of these, as this increases the likelihood of being found by potential buyers and provides them with further important details about your product.
In your description, use relevant terms and keywords that you want to be found using via the search function or, if necessary, directly through Google. The right keywords make it easier for potential buyers to find your item or work.
The chosen terms must, of course, be meaningfully related to your article. If this connection is lacking, it violates our guidelines. Ultimately, such behavior misleads users on Kunstplaza .
If there is concrete evidence of violations of these guidelines, we reserve the right to delete or block your ad(s) in whole or in part without prior notice.
Repeated or serious violations may lead to exclusion from participation in the Kunstplaza online gallery.
e) Place links carefully and thoughtfully
Links that direct members and visitors of the platform to external, commercial websites are prohibited on Kunstplaza .
If you run your own website, blog, or want to link your fan or company page on a social network (for example, Facebook, Pinterest, or Twitter), you can do this in the description of your ad in the appropriate place (see the designated field), on your profile, or in the community groups.
You are also welcome to link to information that provides more detailed information about the components of your advertisements, works, or offers
However, when setting links, always bear in mind that you are responsible for checking whether the linked pages comply with applicable law.
f) Be discreet
We all want to protect our data and our privacy. Therefore, please do not publish any personal information that you do not wish to or are not permitted to disclose to third parties. In this regard, please refer to the settings options in your user account and the corresponding instructions.
Do not publish any messages, emails, contact details, or other private information that you have received from other members.
